Abstract

This article analyses Rotal sentence no. 58/2024 (24 April), which declares the nullity of a marriage due to the psychological incapacity of both parties, under can. 1095, no. 3 CIC. The judgment explores the notion of humano modo as a fundamental criterion for evaluating conjugal sexuality and the ability to establish a genuine marital relationship. The link between sexual disorders – such as hypersexuality – and the incapacity to assume essential marital obligations is emphasized, particularly concerning the bonum coniugum. The commentary reconstructs the legal criteria outlined in the decision and offers reflections on the role of personal history and the distinction between voluntary exclusion and incapacity.
