Abstract

This article analyses Rotal sentence no. 58/2024 (24 April), which declares the nullity of a marriage due to the psychological incapacity of both parties, under can. 1095, no. 3 CIC. The judgment explores the notion of humano modo as a fundamental criterion for evaluating conjugal sexuality and the ability to establish a genuine marital relationship. The link between sexual disorders – such as hypersexuality – and the incapacity to assume essential marital obligations is emphasized, particularly concerning the bonum coniugum.
